The Rosenthal Fair Debt Collection Practices Act (California Civil Code § 1788) is a California state law that mirrors the federal FDCPA but goes further in one critical way: it applies to original creditors, not just third-party debt collectors. This means that if the original lender or creditor engages in abusive, false, or deceptive collection practices, they are subject to California law — a protection that does not exist under the federal FDCPA. This is unique among US states and gives California consumers significantly broader protections against collector misconduct.
California’s wage garnishment limit is the lesser of: 25% of disposable earnings, or the amount by which disposable earnings exceed 40 times California’s current minimum wage per week. As of January 2024, California’s minimum wage is $16 per hour, which means 40 times $16 equals $640 per week in protected earnings. For workers earning near or below that threshold, this can mean little to no wages are legally garnishable — more protective than the federal standard, which uses the federal minimum wage of $7.25/hr.
