Florida Credit Repair FAQs
Florida has two main statute of limitations windows for consumer debt. Written contracts — such as personal loans and most signed credit agreements — have a 5-year limit under Fla. Stat. § 95.11(2)(b). Open accounts, including credit cards and open lines of credit, carry a shorter 4-year limit under Fla. Stat. § 95.11(3)(k). The clock generally starts from the date of first delinquency. After the applicable SOL expires, a creditor may no longer sue to collect the debt, though it may still appear on your credit report for up to 7 years under federal FCRA rules.
It depends on your household status. Florida law under Fla. Stat. § 222.11 provides one of the strongest wage garnishment protections in the country. If you qualify as a "head of household" — meaning you provide more than half the support for a dependent child or other dependent — 100% of your wages are exempt from garnishment for consumer debt. For individuals who do not qualify for the head of household exemption, the standard federal rule applies: creditors may garnish up to 25% of disposable income or the amount by which weekly disposable earnings exceed 30 times the federal minimum wage, whichever is less.
Florida's head of household exemption under Fla. Stat. § 222.11 provides that if you provide more than half the support for a dependent person — such as a child, spouse, or parent — your wages cannot be garnished for consumer debts including credit cards, personal loans, and medical bills. This protection is automatic and does not require a court filing to invoke. It is one of the broadest wage exemptions in any US state. Exceptions apply for federal taxes, child support and alimony orders, federally guaranteed student loans, and court-ordered criminal restitution.
Florida has no state income tax, which means the state government cannot intercept state tax refunds to satisfy consumer debts the way some other states do. However, federal income tax refunds are still subject to federal offset for federally backed debts such as student loans in default or past-due child support. The absence of state income tax does not affect how credit reporting works — the FCRA governs that at the federal level. For Florida consumers, the most relevant state-level protections remain the head of household wage exemption and the SOL windows on debt.
Credit report retention is governed by federal law — the Fair Credit Reporting Act — not Florida state law. Most negative items including late payments, collections, and charge-offs may remain for up to 7 years from the date of first delinquency. Chapter 7 bankruptcies may remain for up to 10 years. The fact that a Florida debt has passed the statute of limitations does not automatically remove it from your report. If an item is inaccurate, incomplete, or unverifiable, you have the right to dispute it with the credit bureaus regardless of its age.
