Is Credit Repair Legal in New York?
Yes. Credit repair is legal in New York and governed at the federal level by the Credit Repair Organizations Act (CROA) and the Fair Credit Reporting Act (FCRA). New York has a split statute of limitations on consumer debt. Written contracts are governed by CPLR § 213, which provides a 6-year window from the date of first default. Open accounts including credit cards are governed by CPLR § 214, which provides only a 3-year window — one of the shortest credit card SOLs in the nation. This distinction is critically important: a New York credit card that went delinquent may become time-barred for court collection after just 3 years.
New York’s 2022 Consumer Credit Fairness Act (signed 2021, effective 2022) goes even further: debt older than 3 years cannot be collected in New York state courts, and collectors must affirmatively disclose when debt is time-barred if they attempt to collect it. This is one of the strongest state-level consumer debt protections in the nation. Regarding wage garnishment: New York caps garnishment at 10% of gross wages — one of the most protective caps in the country. A court judgment is required before any garnishment can begin. New York also provides additional exemptions for income at or below 250% of the poverty level.
