After that period, a time-barred defense may be available — though the debt may still appear on your credit report for up to 7 years under the FCRA.
Regarding wage garnishment: a court judgment is required before any garnishment can begin in Oregon. Oregon provides a more protective exemption than the federal floor: wages below the Oregon minimum wage multiplied by 40 hours per week are fully exempt from garnishment. Because Oregon’s minimum wage is higher than the federal minimum, Oregon’s effective wage exemption floor is higher than what federal law requires — meaning more of a lower-income Oregon worker’s paycheck is protected from garnishment.
